RECOMMENDATIONS / KEY DECISIONS REQUIRED:

1.   To review the covert surveillance activity undertaken by the authority in 2019

 

2.   To review the corporate procedure on the conduct of such surveillance and approve changes for 2020.

 

 

REASONS:

Guidance recommends elected members maintain an overview of the use of covert surveillance by the authority and annually review the policy and procedures governing those activities

Directed Surveillance

 

During 2019 no authorisations have been issued under this Act for the conduct of directed surveillance

 

Covert human Intelligence Sources

 

No authorisations have been issued for the use of Covert Human Intelligence Sources during 2019.

 

Interception of Communications Data

 

No authorisations have been issued by the authority for the interception of communications data during 2019.

 

Unauthorised Covert Surveillance

There have been no reports of unauthorised surveillance during 2019

 

Statistical Returns

 

Annual returns reflecting the above have been provided to the Office of the Surveillance Commissioner and the Interception of Communications Commissioner when requested

 

Investigatory Powers Commissioner (IPC) Inspection

 

During the year the authority was the subject of an inspection by the IPC, which reviewed the authority’s policies, procedures and records. A copy of the letter from the Commissioner confirming the outcome of the inspection is annexed to this report. In relation to the points raised in the Commissioner’s letter;

  1. The Council’s procedure document has been amended in accordance with the suggestions made and is attached for approval.
  2. Dip sampling of internet usage has been undertaken for the period October to December 2019. No evidence of unauthorised directed surveillance was revealed.
  3. Arrangements are in the process of being made to hold the ‘table-top’ exercises suggested.
  4. In addition a register of RIPA queries was established on 30/09/19 and since then a total of 7 queries have been received regarding use of covert surveillance powers and in each case advice given which has avoided the need for covert surveillance to be undertaken.
