·       Apologies for absence were received from Councillors P. Edwards and I .J.Jackson;

·       Members stood in silent tribute to the memory of Councillor Tom Theophilus, former Chair of the Licensing Committee, who had passed away recently.

There were no declarations of personal interest.

The Committee considered an application from Mr Dylan Wyn Evans of 47 Trewern, Saron, Llandysul, for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence. 

The Committee interviewed Mr Evans with regard to his application.

The Public Health Services Manager recommended that Mr Evan’s application be granted with a warning as to his future conduct.

RESOLVED that, in line with the Council’s guidelines, the application submitted by Mr Dylan Wyn Evans for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence be granted with a warning as to his future conduct.

The Committee was advised that Mr. Squire had informed the Authority that he would not be able to attend the meeting that day.

UNANIMOUSLY RESOLVED that consideration of the application from Mr David William Squireto renew his Hackney Carriage/Private Hire Dual Driver’s Licence be deferred to the next meeting of the Committee.

The Committee considered an application from Mr. Andrew Paul Roberts of 18 Swiss Valley, Llanelli, to Licence a BMW 330D registration number BX11 KPK as a Hackney Carriage Vehicle with the authority. The Committee interviewed Mr. Roberts, who was accompanied by his solicitor, with regard to his application.

The Public Health Services Manager recommended that Mr. Roberts’ application be refused.

The Committee thereupon

RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

Following the adjournment the Committee reconvened to advise of its decision.

RESOLVED, in line with the Council’s guidelines, that the application submitted by Mr. Andrew Paul Roberts of 18 Swiss Valley, Llanelli, to Licence a BMW 330D registration number BX11 KPK as a Hackney Carriage Vehicle with the authoritybe refused.

Reasons

·       The Council has a clear policy that it will not licence vehicles over 5 years old;

·       The Committee carefully considered whether it should depart from that policy in this case and concluded that it should not;

·       The Committee did not feel that the explanation given for not submitting the application within the time specified was sufficient to justify departure from the Council’s policy in this case.

RESOLVED that the minutes of the meeting of the Licensing Committee held on the 22^nd June, 2016 be signed as a correct record subject to the inclusion of Councillor T. Davies’s name in the list of attendees.
