UNANIMOUSLY RESOLVED that the minutes of the meeting of Licensing Committee held on the 5th March, 2024 be signed as a correct record.

EXCLUSION OF THE PUBLIC.

THE REPORTS RELATING TO THE FOLLOWING ITEMS ARE NOT FOR PUBLICATION AS THEY CONTAIN EXEMPT INFORMATION AS DEFINED IN PARAGRAPH 12 OF PART 4 OF SCHEDULE 12A TO THE LOCAL GOVERNMENT ACT 1972 AS AMENDED BY THE LOCAL GOVERNMENT (ACCESS TO INFORMATION) (VARIATION) (WALES) ORDER 2007 AS THEY CONTAIN INFORMATION RELATING TO A PARTICULAR INDIVIDUAL.

 

IF, FOLLOWING THE APPLICATION OF THE PUBLIC INTEREST TEST, THE COMMITTEE RESOLVES PURSUANT TO THE ACT TO CONSIDER THESE ITEMS IN PRIVATE, THE PUBLIC WILL BE EXCLUDED FROM THE MEETING DURING SUCH CONSIDERATION.

RESOLVED, pursuant to the Local Government Act 1972, as amended by the Local Government (Access to Information) (Variation) (Wales) Order 2007, that the public be excluded from the meeting during consideration of the following items as the reports contained exempt information as defined in paragraph 12 of Part 4 of Schedule 12A to the Act.

MR LEE JENKINS - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Senior Licensing Officer referred to the report relating to Mr Lee Jenkins of 89 James Street, Llanelli who is a licensed Hackney Carriage/Private Hire Dual driver with the authority.  He requested that its consideration be withdrawn in order that information can be obtained regarding an occurrence since the item had been placed on the agenda.

 

UNANIMOUSLY RESOLVED that consideration of the report relating to Mr Lee Jenkins be withdrawn in order that information can be obtained concerning an occurrence since the item had been placed on the agenda.

6.

MR SIMON MATTHEW HARDY - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee was informed that Mr Simon Matthew Hardy of 3 Parc Heol Ddu, Pen Y Mynydd was a licensed Hackney Carriage/Private Hire Dual driver with the authority whose licence had previously been suspended.  The Senior Licensing Officer informed the Committee of the circumstances relating to the suspension of Mr Hardy’s Licence.

 

The Committee interviewed Mr Hardy with regard to the issues raised by the Senior Licensing Officer. 

 

The Senior Licensing Officer recommended that the suspension of Mr Hardy’s Hackney Carriage/Private Hire Dual Driver’s licence be lifted.

 

The Committee thereupon

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

 

RESOLVED that the suspension of Mr Hardy’s Hackney Carriage/Private Hire Dual Driver’s licence be lifted.

 

Reason

 

On the evidence presented, the Committee was satisfied that the applicant was a fit and proper person to hold a licence.

7.

MR GEOFFREY KARIN DAVIES - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

The Committee was informed that Mr Geoffrey Karin Davies of 37a New Road, Dafen, Llanelli is a licensed Hackney Carriage /private hire dual driver with the authority. The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of Mr Davies’ license.

 

The Committee interviewed Mr Davies with regard to the issues raised by the Senior Licensing Officer. 

 

The Senior Licensing Officer recommended that Mr Davies’ licence be revoked.

 

The Committee thereupon

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

  

RESOLVED that Mr Geoffrey Karin Davies’ Hackney Carriage/Private Hire Dual Driver’s Licence be revoked.

 

Reason

 

The facts outlined to the committee provided reasonable cause to warrant revocation of the licence and therefore it was not satisfied that Mr Geoffrey Karin Davies was a fit and proper person to continue to hold a licence.
