LICENSING ACT 2003 LICENSING POLICY REVIEW CUMULATIVE IMPACT ASSESSMENTS pdf icon PDF 104 KB

The Committee considered a report on the Licensing Policy Review Cumulative Impact Assessments in accordance with the Licensing Act 2003.

 

The Committee noted that as part of the Authority was currently reviewing the existing the Cumulative Impact Assessments (CIA) in force for Station Road, Llanelii and Lammas Street, Carmarthen as well as views regarding the adoption of a further Cumulative Impact Assessment for Not Square, King Street and Queen Street, Carmarthen.  It was reported that these areas were being consulted upon due being a Hot Spot areas of alcohol related Crime and Disorder and the levels of Crime and Disorder being reported respectively.

 

The consultation was an opportunity for local residents, businesses, existing licence holders and their representatives to formally comment on the proposal and provide feedback to the Authority.  To assist respondents, it was reported that an online survey on the council’s website had been made available.

 

Members noted that it would be important for any evidence included in the revised Cumulative Impact Assessments to be robust and relevant to the current problems described.

 

In response to a query raised in respect to the effectiveness of the Cumulative Impact Assessments that were in place, the Licensing Lead explained that whilst the effectiveness was difficult to quantify, there had been applications within the Impact areas which had been turned down.

 

UNANIMOUSLY RESOLVED that members of the Committee complete the online survey as part of the Licensing Policy consultation and encourage other groups and persons to participate in the consultation exercise.

 

5.

EXCLUSION OF THE PUBLIC

THE REPORTS RELATING TO THE FOLLOWING ITEMS ARE NOT FOR PUBLICATION AS THEY CONTAIN EXEMPT INFORMATION AS DEFINED IN PARAGRAPH 12 OF PART 4 OF SCHEDULE 12A TO THE LOCAL GOVERNMENT ACT 1972 AS AMENDED BY THE LOCAL GOVERNMENT (ACCESS TO INFORMATION) (VARIATION) (WALES) ORDER 2007 AS THEY CONTAIN INFORMATION RELATING TO A PARTICULAR INDIVIDUAL.  

 

IF, FOLLOWING THE APPLICATION OF THE PUBLIC INTEREST TEST, THE COMMITTEE RESOLVES PURSUANT TO THE ACT TO CONSIDER THESE ITEMS IN PRIVATE, THE PUBLIC WILL BE EXCLUDED FROM THE MEETING DURING SUCH CONSIDERATION.

RESOLVED, pursuant to the Local Government Act 1972, as amended by the Local Government (Access to Information) (Variation) (Wales) Order 2007, that the public be excluded from the meeting during consideration of the following items as the reports contained exempt information as defined in paragraph 12 of Part 4 of Schedule 12A to the Act.

MRS BEVERLEY WILMA LEWIS - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee considered an application from Mrs Beverley Wilma Lewis of 21 Ty Plas Isaf, Hendre Road, Llangennech for the grant of a hackney carriage/private hire dual driver’s licence.

 

The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of the application.

 

The Committee thereupon interviewed Mrs Lewis with regard to the application and the issues raised by the Senior Licensing Officer.

 

The Senior Licensing Officer recommended that Mrs Lewis’ application be granted with a warning as to her future conduct.

 

UNANIMOUSLY RESOLVED that the application submitted by Mrs Beverley Wilma Lewis for the renewal of a Hackney Carriage/Private Hire Dual Driver’s Licence be granted with a warning as to her future conduct.

 

7.

MR ROBERT DANIEL ISAAC - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

 

The Senior Licensing Officer informed the Committee that Mr Robert Daniel Isaac was unable to attend the meeting today and requested permission to deferconsideration of Mr. Isaac’s application to the next meeting.

 

UNANIMOUSLY RESOLVED that consideration of the application submitted by Mr Robert Daniel Isaac be deferred to the next meeting of the Committee.

 

8.

MR DARREN LEE HUNG - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee considered an application from Mr Darren Lee Hung of 9 Clos Y Gelli, Llanelli for the grant of a hackney carriage/private hire dual driver’s licence.

 

The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of the application.

 

The Committee thereupon interviewed Mr Hung with regard to the application and the issues raised by the Senior Licensing Officer.

 

The Senior Licensing Officer recommended that Mr Hung’s application be granted with a warning as to his future conduct.

 

The Committee thereupon

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

 

Following the adjournment, the Committee reconvened to advise of its decision.

 

RESOLVED that the application submitted by Mr Darren Lee Hung for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence be granted with a warning as to his future conduct.

 

Reason

On the evidence presented the Committee was satisfied that the applicant was a fit and proper person to hold a licence.
