UNANIMOUSLY RESOLVED that the minutes of the meeting of Licensing Committee held on the 23rd January, 2024 be signed as a correct record.

EXCLUSION OF THE PUBLIC.

THE REPORTS RELATING TO THE FOLLOWING ITEMS ARE NOT FOR PUBLICATION AS THEY CONTAIN EXEMPT INFORMATION AS DEFINED IN PARAGRAPH 12 OF PART 4 OF SCHEDULE 12A TO THE LOCAL GOVERNMENT ACT 1972 AS AMENDED BY THE LOCAL GOVERNMENT (ACCESS TO INFORMATION) (VARIATION) (WALES) ORDER 2007 AS THEY CONTAIN INFORMATION RELATING TO A PARTICULAR INDIVIDUAL.

 

IF, FOLLOWING THE APPLICATION OF THE PUBLIC INTEREST TEST, THE COMMITTEE RESOLVES PURSUANT TO THE ACT TO CONSIDER THESE ITEMS IN PRIVATE, THE PUBLIC WILL BE EXCLUDED FROM THE MEETING DURING SUCH CONSIDERATION.

RESOLVED, pursuant to the Local Government Act 1972, as amended by the Local Government (Access to Information) (Variation) (Wales) Order 2007, that the public be excluded from the meeting during consideration of the following items as the reports contained exempt information as defined in paragraph 12 of Part 4 of Schedule 12A to the Act.

MR CHARLES WYNNE JONES - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

To consider an application from Mr Charles Wynne Jones of 90 Waun Burgess, Carmarthen for the grant of a hackney carriage/private hire dual driver’s licence.

 

The Senior Licensing Officer informed the Committee members of the issues that had arisen in respect of his license. 

 

The Committee interviewed Mr Jones with regard to the issues raised by the Senior Licensing Officer.

 

The Senior Licensing Officer recommended that That Mr Jones’ application be granted with a warning as to his future conduct.

 

RESOLVED that, Mr Charles Wynne Jones’ Hackney Carriage/Private Hire Dual Drivers Licence be granted with a warning as to his future conduct.

 

6.

MISS SAMANTHA BERYL GRIFFITHS - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee was informed that Miss Samantha Beryl Griffiths of 105 Amanwy, Llanelli was a licensed Hackney Carriage/Private Hire Dual driver with the authority.  The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of Miss Griffiths’ license.

 

The Committee interviewed Miss. Griffiths with regard to the issues raised by the Senior Licensing Officer.  Oral representations were also received from the Dyfed Powys Police representative.

 

The Senior Licensing Officer recommended that Miss Griffiths’ licence be revoked.

 

The Committee thereupon

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

 

Following the adjournment, the Committee reconvened to advise of its decision.

 

RESOLVED that Miss Samantha Beryl Griffiths’ Hackney Carriage/Private Hire Dual Driver’s Licence be suspended until 30th May 2024 to enable Miss Griffiths to provide medical evidence as to her fitness to hold a licence.

 

Reason

 

The facts outlined to the committee provide reasonable cause to suspend the licence but that revocation would not be a proportionate response.

 

7.

MR DANIEL JAMES MORSE - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee was informed that Mr Daniel James Morse of 9 Upper Robinson Street, Llanelli was a licensed Hackney Carriage/Private Hire Dual driver with the authority. .

 

The Senior Licencing Officer advised that Mr. Morse was not in attendance and for the Committee to consider the case in his absence.

 

The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of Mr Morse’s licence and recommended that Mr Morse’s licence be revoked.

 

UNANIMOUSLY RESOLVED that Mr Daniel James Morse’s Hackney Carriage/Private Hire Dual Driver’s Licence be revoked.

 

Reason

 

The facts outlined to the committee provide reasonable cause to revoke the licence.

 

8.

MR EDWARD WALLACE HERBERT - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee was informed that Mr Edward Wallace Herbert of 37 Park Hall, Carmarthen was a licensed Hackney Carriage/Private Hire Dual driver with the authority.

 

The Senior Licencing Officer advised that Mr. Herbert was not in attendance and for the Committee to consider the case in his absence.

 

The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of Mr Herbert’s license.

 

The Senior Licensing Officer recommended that Mr Herbert’s licence be revoked.

 

UNANIMOUSLY RESOLVED that MrEdward Wallace Herbert’s Hackney Carriage/Private Hire Dual Driver’s Licence be revoked.

 

Reason

 

The facts outlined to the committee provide reasonable cause to revoke the licence.

 

9.

MR SIMON MARTIN VAUGHAN - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee was informed that Mr Simon Martin Vaughan of 9 Carregamman Isaf, Ammanford was a licensed Hackney Carriage/Private Hire Dual driver with the authority. 

 

The Senior Licencing Officer advised that Mr. Vaughan was not in attendance and for the Committee to consider the case in his absence.

 

The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of Mr Vaughan’s license.

 

The Senior Licensing Officer recommended that Mr Vaughan’s licence be revoked.

 

UNANIMOUSLY RESOLVED that Mr Simon Martin Vaughan’s Hackney Carriage/Private Hire Dual Driver’s Licence be revoked.

 

Reason

 

The facts outlined to the committee provide reasonable cause to revoke the licence.
