There were no declarations of personal interest.

The Assistant Solicitor briefed all present on the procedure for the meeting and advised the Sub- Committee that an application had been received for the grant of a personal licence for Miss Sarah Pearce of Flat 2, 2-4 Norton Road, Penygroes, Llanelli, SA14 7RS.

The Committee were asked to consider an application from Miss Sarah Pearce for a personal licence, under Section 117 of the Licensing Act 2003.

The police had objected to the Application under section 120(5) of the Licensing Act 2003, as the applicant had been convicted of a “relevant offence” listed in Schedule 4 of the Act, and were of the view that granting the licence would undermine the Crime Prevention Objective in the 2003 Act.

The Sub-Committee received observations from the Police representative regarding the convictions and both the applicant, and the Sub-Committee, were provided with an opportunity of questioning the evidence provided by the Police representative.

The applicant, who was supported by her mother thereupon addressed the Sub-Committee in support of her application, and the Sub-Committee and the Police representative were afforded the opportunity of questioning the evidence provided.  The applicant also submitted two written representations in support of her application.

The Sub-Committee thereupon

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

Following the adjournment, the Sub-Committee reconvened to advise of its decision. Having considered all the evidence before it, the Sub-Committee

UNANIMOUSLY RESOLVED that Miss Pearce’s application for a personal license under the Licensing Act 2003 be refused.

Reason

The Committee having regard to the evidence and representation presented, was not satisfied that Miss Pearce was a fit and proper person to hold a licence and that granting the licence was likely to give rise to crime and disorder and would undermine the Crime Prevention Objective of the Licensing Act 2003.
