The Committee considered an application submitted by Councillor Jeanette Gilasbey of Carmarthenshire County Council and Kidwelly Community Council, for the grant of a dispensation under the provisions of the Standards Committees (Grant of Dispensations) (Wales) Regulations to speak in relation to matters regarding Kidwelly Industrial Museum and Trust.

 

It was reported that a dispensation was sought as Councillor Gilasbey had a personal interest in these matters by virtue of paragraph 10(2)(ee) of the Code of Conduct in that she is a member of Kidwelly Industrial Museum and Trust.

 

Councillor Gilasbey’s interest was also prejudicial as a member of the public, with full knowledge of the facts, would reasonably regard that interest as being so significant that it would be likely to prejudice the Councillor’s judgement of the public interest.

 

Councillor Gilasbey had accordingly requested that a dispensation be granted under Regulation 2 (d) (e) (f) (g) and (h) of the Standards Committees (Grant of Dispensation) (Wales) Regulations 2001.

 

The Committee noted that the dispensation to speak did NOT cover matters in respect of any regulatory application made by or on behalf of the Museum and/or Trust.  This also includes planning or licensing applications.

 

The Legal Services Manger advised the Committee that in considering the application it should note that paragraphs 2 (d) and (h) were the most appropriate grounds should the Committee be minded to approve the request to speak only.

 

Following a discussion it was

 

UNANIMOUSLY RESOLVED that dispensation be granted under Regulation 2 (d) and (h) of the Standards Committees (Grant of Dispensation) (Wales) Regulations 2001 to Councillor Jeanette Gilasbey to SPEAK only at meetings of Carmarthenshire County Council and Kidwelly Town Council in relation to matters regarding the Kidwelly Industrial Museum and Trust and that the dispensation be valid until 31st December 2020.

The Committee considered an application submitted by Councillor Ken Lloyd of Carmarthenshire County Council and Carmarthen Town Council, for the grant of a dispensation under the provisions of the Standards Committees (Grant of Dispensations) (Wales) Regulations to speak and make written representations in relation to matters regarding Heart of Wales Line Travellers Association (HOWLTA).

 

The Legal Services Manager highlighted to the Committee that Councillor Lloyd was also a member of the Planning Committee.  In light of this, the Committee requested that it would be useful that this information is included on future reports.

The Legal Services Manager, stated that it may be beneficial for Committee Members to be provided with a list of County Councillor’s interests as part of the report.  Members agreed that this information as part of the report would be beneficial in that it would enable them to make a more informed decision.

 

The Committee considered an application submitted by Councillor Williams of Manordeilo and Salem Community Council, for the grant of a dispensation under the provisions of the Standards Committees (Grant of Dispensations) (Wales) Regulations to speak and make written representations in relation to matters regarding Carmarthen County Council’s revised Local Development Plan (LDP).

 

It was reported that a dispensation was sought as Councillor Williams had a personal interest in these matters by virtue of paragraph 10(2)(ee) of the Code of Conduct in that any Councils discussions on the LDP was likely to affect Councillor Williams’ family home.

 

Councillor William’s interest was also prejudicial as a member of the public, with full knowledge of the facts, would reasonably regard that interest as being so significant that it would be likely to prejudice the Councillor’s judgement of the public interest.

 

Councillor William had accordingly requested that a dispensation be granted under Regulation 2 (d) (e) (f) (g) and (h) of the Standards Committees (Grant of Dispensation) (Wales) Regulations 2001.

 

Following a discussion it was

 

RESOLVED that the application submitted by Councillor Owen Alexander Marmion Williams for dispensation to speak and make written representations at meetings of Manordeilo and Salem Community Council in respect of matters relating to the Carmarthen County Council’s revised Local Development Plan (LDP) be refused.

The Committee considered an application submitted by Councillor Loynton of Manordeilo and Salem Community Council, for the grant of a dispensation under the provisions of the Standards Committees (Grant of Dispensations) (Wales) Regulations to speak and make written representations in relation to matters regarding Carmarthen County Council’s revised Local Development Plan (LDP).

 

It was reported that a dispensation was sought as Councillor Loynton had a personal interest in these matters by virtue of paragraph 10(2)(ee) of the Code of Conduct in that he owns land which is likely to be affected by the revised LDP due to a common boundary.

 

Councillor Loynton’s interest was also prejudicial as a member of the public, with full knowledge of the facts, would reasonably regard that interest as being so significant that it would be likely to prejudice the Councillor’s judgement of the public interest.
