RESOLVED pursuant to the Local Government Act 1972, as amended by the Local Government (Access to Information) (Variation) (Wales) Order 2007 that the following items were not for publication as the reports contained exempt information as defined in Paragraph 14 of Part 4 of Schedule 12A to the Act.

GLANMARLAIS RESIDENTIAL CARE HOME, LLANDYBIE

Following the application of the public interest test it was RESOLVED pursuant to the Act referred to in Minute 3 above not to publicise the content of the report as it contained exempt information relating to the financial or business affairs of any particular person (including the Authority holding that information (Paragraph 14 of Part 4 of Schedule 12A to the Act)

 

The Public interest test in this matter related to the fact that disclosure of the report would undermine the Council’s statutory duty to obtain the best possible price for the sale of this asset. On balance, and having regard to the circumstances of the case, the public interest in maintain the exemption outweighed the public interest in disclosing the information contained in the report.

 

The Executive Board Member considered a report on proposals for the disposal of the former Glanmarlais Residential Care Home, Llandybie which had become surplus to Council requirements.

 

RESOLVED that the Glanmarlais Residential Care Home, be offered for sale, and that the property be marketed on an unrestricted basis as per the advice of the local agents.

Following the application of the public interest test it was RESOLVED pursuant to the Act referred to in Minute 3 above not to publicise the content of the report as it contained exempt information relating to the financial or business affairs of any particular person (including the Authority holding that information (Paragraph 14 of Part 4 of Schedule 12A to the Act)

 

The Public interest test in this matter related to the fact that the rep[ort contained financial information relating to the likely value of the property, disclosure of which would undermine the Council’s ability to secure higher alternative bids prior to the exchange of contracts. Accordingly, the public interest in maintain the exemption under Paragraph 14, Part 4 Schedule 12A of the 1972 Act outweighed the public interest in disclosing the report.

 

The Executive Board Member considered a report on proposals for the disposal of the Council owned land at Foundry Row, Ammanford which had become surplus to Council requirements.

 

RESOLVED, that the Council proceed with the sale of land at Foundry Row, Ammanford to the bidder detailed within the report, subject to the inclusion of a ‘buy back’ clause
