PUBLIC FOOTPATH 10/1, THE PLASH INN, LLANFALLTEG PDF 1 MB Minutes: The Executive Board Member considered a report detailing an application for the diversion of Registered Public Footpath 10/1 under Section 119 of the Highways Act 1980 which was made in the interests of the landowner.
The Executive Board Member noted that the paragraph within the ‘Recommendations / Key Decisions required’ section on the front cover of the report should read ‘Approval from the Executive Board Member for Culture, Sport and Tourism to make the necessary Public Path Order.’
The Countryside Access Officer concluded that the application satisfied the tests laid out in the aforementioned Act namely that it was expedient that the line of the path or part of the line should be diverted in the interests of either the owner, lessee or occupier of land crossed by the path or of the public, that the proposed diversion was not substantially less convenient to the public and did not adversely affect public enjoyment of the path as a whole.
The Countryside Access Officer explained the application and highlighted the proposed footpath diversion to the Executive Board Member, as detailed in the map appended to the report.
The Countryside Access Officer explained that the Council had carried out a non-statutory pre-Order consultation with statutory consultees and interested parties in an attempt to address any issues and/or queries raised in support or objection to the proposal. Furthermore, in order to comply with the diversion of public rights of way carried out under Section 119 of the Highways Act 1980, the Authority, should the order be approved, would commence a formal statutory public consultation.
RESOLVED that the application for the diversion of Registered Public Footpath 10/1, The Plash Inn, Llanfallteg be approved and that the appropriate Public Path Diversion Order be made under section 119 of the Highways Act 1980.

Following this consultation, the Executive Board Member noted that the applicant intended to put measures in place in order to resolve some of the personal privacy issues raised by objectors.
Furthermore, in order to comply with the diversion of public rights of way carried out under Section 119 of the Highways Act 1980, the Authority, should the order be approved, would commence a formal statutory public consultation.
RESOLVED that the application for the diversion of Registered Public Footpath 14/6, Dolcoed, Llanllwni be approved and that the appropriate Public Path Diversion Order be made under section 119 of the Highways Act 1980.
