MR THOMAS JAMES - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE pdf icon PDF 119 KB

Minutes:

(Note: Councillor T. Bowen left the Council Chamber during the determination of this item by the Committee).

The Committee were advised that Mr Thomas James of 62 Glyncoed Terrace, Llanelli, was a licensed Hackney Carriage/Private Hire Dual Driver with the authority and that an issue had arisen with regard to his licence.

The Committee interviewed Mr James with regard to that issue. The Committee also invited the complainants to comment on the evidence received.

The Public Health Services Manager recommended that Mr James’s Hackney Carriage/Private Hire Dual Drivers Licence be suspended for 7 days.

The Committee thereupon:

RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

Following the adjournment the Committee reconvened to advise of its decision.

UNANIMOUSLY RESOLVED that, in line with the Council’s guidelines, Mr Thomas James be issued with a final warning as to his future conduct.

Reasons:

On the evidence presented, the Committee finds that:

(1)  Mr James was informed that a wheelchair would need to go in the boot of the taxi, when the booking was made.

(2)  Mr James had a bad back which restricted his ability to lift the wheelchair into the boot.

(3)  Mr James did assist the complainant to slide the wheelchair into the boot and was able to remove it at the end of the journey unaided.

(4)  That knowing a wheelchair was involved, Mr James should have sent another taxi to collect the complainant. His failure to do so caused unnecessary embarrassment to the complainant.

(5)  That although Mr James provided reliable evidence in light of his own health issues, his failure to send another taxi is good reason to give him a final warning in this case.
