UNANIMOUSLY RESOLVED that the minutes of the meeting of Licensing Committee held on the 27th July, 2023 be signed as a correct record.

EXCLUSION OF THE PUBLIC

THE REPORTS RELATING TO THE FOLLOWING ITEMS ARE NOT FOR PUBLICATION AS THEY CONTAIN EXEMPT INFORMATION AS DEFINED IN PARAGRAPH 12 OF PART 4 OF SCHEDULE 12A TO THE LOCAL GOVERNMENT ACT 1972 AS AMENDED BY THE LOCAL GOVERNMENT (ACCESS TO INFORMATION) (VARIATION) (WALES) ORDER 2007 AS THEY CONTAIN INFORMATION RELATING TO A PARTICULAR INDIVIDUAL. 

 

IF, FOLLOWING THE APPLICATION OF THE PUBLIC INTEREST TEST, THE COMMITTEE RESOLVES PURSUANT TO THE ACT TO CONSIDER THESE ITEMS IN PRIVATE, THE PUBLIC WILL BE EXCLUDED FROM THE MEETING DURING SUCH CONSIDERATION.

RESOLVED, pursuant to the Local Government Act 1972, as amended by the Local Government (Access to Information) (Variation) (Wales) Order 2007, that the public be excluded from the meeting during consideration of the following items as the reports contained exempt information as defined in paragraph 12 of Part 4 of Schedule 12A to the Act.

MR IAN RICHARD PRICE - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

The Senior Licensing Officer referred to the application received from Mr Ian Richard Price of Crynga Bach, Llwyndrain, Llanfyrnach for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence.  As Mr Price was not in attendance at the meeting the Senior Licensing Officer requested that its consideration be deferred to the next meeting.

 

UNANIMOUSLY RESOLVED that consideration of the application submitted by Mr Price be deferred to the next meeting of the Committee.

6.

MR PHILIP GEORGE MALIPHANT - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

The Committee considered an application from Mr Philip George Maliphant of Ystafell Fach, Llanddarog Road, Llanarthne for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence.

 

The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of the application.

 

The Committee interviewed Mr Maliphant with regard to his application and the issues raised by the Senior Licensing Officer.

 

The Senior Licensing Officer recommended that Mr Maliphant’s application be granted with a warning as to his future conduct.

 

The Committee thereupon:

 

RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

 

Following the adjournment the Committee reconvened to advise of its decision.

 

UNANIMOUSLY RESOLVED that the application submitted by Mr Maliphant for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence be granted with a warning as to his future conduct.

MR ROBERT DANIEL ISAAC - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

MR STEVEN PETER CAREY - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

The Committee considered an application from Mr Steven Peter Carey of 38 Mount Pleasant, Gowerton, Swansea for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence.

 

The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of the application.

 

The Committee interviewed Mr Carey with regard to his application and issues raised by both the Senior Licencing Officer and the Dyfed Powys Police representative.

 

The Senior Licensing Officer recommended that Mr Carey’s application be refused.

 

The Committee thereupon:

 

RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

 

Following the adjournment the Committee reconvened to advise of its decision.

 

RESOLVED that the application submitted by Mr Carey for the grant of a Hackney Carriage/private Hire Dual Drivers Licence be refused.

 

REASONS

Having considered all the evidence presented and having regard to relevant guidance, the Committee was satisfied that the applicant was not a fit and proper person to hold a licence.

MR GEORGE JULIAN PETER CHEESEMAN - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

The Committee was advised that following submission of the information required as part of the Authority’s governance processes, the item had been withdrawn.

 

UNANIMOUSLY RESOLVED that the withdrawal be noted.

MR NATHAN EDWARD JAMES COURTNEY - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

The Committee was advised that following submission of the information required as part of the Authority’s governance processes, the item had been withdrawn.

 

UNANIMOUSLY RESOLVED that the withdrawal be noted.
