UNANIMOUSLY RESOLVED that the minutes of the meeting of Licensing Committee held on the 12th December, 2023 be signed as a correct record.

EXCLUSION OF THE PUBLIC.

THE REPORTS RELATING TO THE FOLLOWING ITEMS ARE NOT FOR PUBLICATION AS THEY CONTAIN EXEMPT INFORMATION AS DEFINED IN PARAGRAPH 12 OF PART 4 OF SCHEDULE 12A TO THE LOCAL GOVERNMENT ACT 1972 AS AMENDED BY THE LOCAL GOVERNMENT (ACCESS TO INFORMATION) (VARIATION) (WALES) ORDER 2007 AS THEY CONTAIN INFORMATION RELATING TO A PARTICULAR INDIVIDUAL.

 

IF, FOLLOWING THE APPLICATION OF THE PUBLIC INTEREST TEST, THE COMMITTEE RESOLVES PURSUANT TO THE ACT TO CONSIDER THESE ITEMS IN PRIVATE, THE PUBLIC WILL BE EXCLUDED FROM THE MEETING DURING SUCH CONSIDERATION.

RESOLVED, pursuant to the Local Government Act 1972, as amended by the Local Government (Access to Information) (Variation) (Wales) Order 2007, that the public be excluded from the meeting during consideration of the following items as the reports contained exempt information as defined in paragraph 12 of Part 4 of Schedule 12A to the Act.

MR BERNARD PRICE - APPLICATION FOR THE GRANT OF A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVER'S LICENCE.

Minutes:

The Committee was informed that Mr Bernard Price, of Parc Doc y Gogledd, Llanelli was a licensed Hackney Carriage/Private Hire Dual driver with the authority.  The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of Mr Price’s license.

 

The Committee interviewed Mr. Price with regard to the issues raised by the Senior Licensing Officer.

 

The Senior Licensing Officer recommended that Mr Price’s application be revoked.

 

The Committee thereupon

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

 

Following the adjournment, the Committee reconvened to advise of its decision.

 

UNANIMOUSLY RESOLVED that Mr Bernard Price’s Hackney Carriage/Private Hire Dual Driver’s Licence be revoked.

 

Reason

 

The facts outlined to the committee provide reasonable cause to revoke the licence.

 

6.

MISS CHELSEA LOUISE MORSE - APPLICATION FOR THE GRANT OF A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVER'S LICENCE.

Minutes:

The Senior Licensing Officer referred to the application received from Miss Chelsea Louise Morse of 13 Trosserch Road, Llangennech for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence and requested that its consideration be deferred to the next meeting in order for additional information to be obtained.

 

UNANIMOUSLY RESOLVED that consideration of the application submitted by Miss Chelsea Louise Morse be deferred to a future meeting of the Committee.

 

 

7.

MR DAVID ANDREW JONES - APPLICATION FOR THE GRANT OF A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVER'S LICENCE.

Minutes:

The Committee was informed that Mr David Andrew Jones of 15 Waun Burgess, Carmarthen was a licensed Hackney Carriage/Private Hire Dual driver with the authority.  The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of Mr Jones’s license.

 

The Committee interviewed Mr Jones with regard to the issues raised by the Senior Licensing Officer.

 

The Senior Licensing Officer recommended that Mr Jones’s application be granted with a warning as to his future conduct.

 

The Committee thereupon:

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

 

Following the adjournment, the Committee reconvened to advise of its decision.

 

UNANIMOUSLY RESOLVED that the application submitted by Mr David Andrew Jones for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence be granted with a warning as to his future conduct.

 

Reason

 

On the evidence presented the Committee was satisfied that the applicant was a fit and proper person to hold a licence.

 

8.

MR RADOSLAW ANDRZEJ WOJTASIAK - APPLICATION FOR THE GRANT OF A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVER'S LICENCE.

Minutes:

The Committee was informed that Mr Radoslaw Andrzej Wojtasiak, of 15 Langland Road, Llanelli was a licensed Hackney Carriage/Private Hire Dual driver with the authority.  The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of Mr Wojtasiak’s license.

 

The Committee interviewed Mr. Wojtasiak, through his representative, with regard to the issues raised by the Senior Licensing Officer and the Dyfed Powys Police representative.

 

The Senior Licensing Officer recommended that Mr Wojtasiak’s application be revoked.

 

The Committee thereupon

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.

 

Following the adjournment, the Committee reconvened to advise of its decision.

 

RESOLVED that Mr Radoslaw Andrzej Wojtasiak be issued with a final warning with recommendation that an anger management course be undertaken.

 

Reason

 

Facts presented were not a reasonable cause to suspend or revoke the licence.

 

9.

MRS NICOLA JAYNE JONES - APPLICATION FOR THE GRANT OF A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVER'S LICENCE.

Minutes:

The Committee was informed that Mrs Nicola Jayne Jones, of 88 Caecoed, Llandybie, Ammanford was a licensed Hackney Carriage/Private Hire Dual driver with the authority. 

 

The Senior Licensing Officer advised that Mrs Jones was not in attendance and for the Committee to consider her case in her absence.

 

The Senior Licensing Officer informed the Committee of the issues that had arisen in respect of Mrs Jones’s license.

 

The Senior Licensing Officer recommended that Mrs Jones’s application be revoked.

 

UNANIMOUSLY RESOLVED that Mrs. Nicola Jayne Jones’sHackney Carriage/Private Hire Dual Driver’s Licence be revoked.

 

Reason

 

The facts presented to the Committee provide a reasonable cause to revoke the licence.
