THE REPORTS RELATING TO THE FOLLOWING ITEMS ARE NOT FOR PUBLICATION AS THEY CONTAIN EXEMPT INFORMATION AS DEFINED IN PARAGRAPH 12 OF PART 4 OF SCHEDULE 12A TO THE LOCAL GOVERNMENT ACT 1972 AS AMENDED BY THE LOCAL GOVERNMENT (ACCESS TO INFORMATION) (VARIATION) (WALES) ORDER 2007 AS THEY CONTAIN INFORMATION RELATING TO A PARTICULAR INDIVIDUAL.

 

IF, FOLLOWING THE APPLICATION OF THE PUBLIC INTEREST TEST, THE COMMITTEE RESOLVES PURSUANT TO THE ACT TO CONSIDER THESE ITEMS IN PRIVATE, THE PUBLIC WILL BE EXCLUDED FROM THE MEETING DURING SUCH CONSIDERATION.

RESOLVED, pursuant to the Local Government Act 1972, as amended by the Local Government (Access to Information) (Variation) (Wales) Order 2007, that the public be excluded from the meeting during consideration of the following items as the reports contained exempt information as defined in paragraph 12 of Part 4 of Schedule 12A to the Act.

MR DAVID PHILIP DALY - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee was informed that Mr David Philip Daly of 23 Gerddi Lingfield, Whitland is a licensed Hackney Carriage/Private Hire Dual driver with the authority. The Senior Licensing Officer informed the Committee of the circumstances that had arisen in relation to Mr Daly’s licence.

 

UNANIMOUSLY RESOLVED that Mr Daley be issued with a warning as to his future conduct.

 

8.

MR JONATHAN MARVIN DAVIES - APPLICATION TO RENEW A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Senior Licensing Officer had requested that this application be deferred to the next Committee meeting.

 

UNANIMOUSLY RESOLVED that Mr Jonathan Marvin Davies’ application to review a Hackney Carriage/Private Hire Dual Driver’s License be deferred to the next Committee meeting.

 

9.

MR THOMAS PETER HAYNES FULLER - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee considered an application from Mr Thomas Peter Haynes Fuller of 4 Lon Cae Ffynnon, Llandeilo for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence.  The Committee interviewed Mr Fuller with regard to his application and the issues raised by the Senior Licencing Officer.

 

The Police Representative provided information in relation to the issues raised to the Committee.

 

The Senior Licensing Officer recommended that Mr Fuller’s application be granted with a warning as to his future conduct.

 

The Committee thereupon:

 

RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972. Following the adjournment, the Committee reconvened to advise of its decision.

 

RESOLVED that the application submitted by Mr Thomas Peter Haynes Fuller for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence be granted with a warning as to his future conduct.

 

10.

MR JON-PAUL THOMAS ENGLEFIELD - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee considered an application from Mr Jon-Paul Thomas Englefield of 28 Glasfryn, Llanelli for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence.  The Committee interviewed Mr Englefield with regard to his application and the issues raised by the Senior Licencing Officer.

 

The Senior Licensing Officer recommended that Mr Englefield’s application be granted with a warning as to his future conduct.

 

The Committee thereupon:

 

RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.Following the adjournment, the Committee reconvened to advise of its decision.

11.

MISS CAROLYN ANNE EVANS - HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee was informed that Miss Carolyn Anne Evans of 2 Hengegin, Llandyfan, Ammanford is a licensed Hackney Carriage/Private Hire Dual driver with the authority.

 

The Senior Licensing Officer informed the Committee of the circumstances that had arisen in relation to Miss Evans’ licence.

 

The Committee interviewed Miss Evans with regard to the issues raised by the Senior Licensing Officer.  The Senior Licensing Officer recommended that Miss Evans’ license be revoked.

 

The Police Representative was afforded the opportunity to provide information in relation to the issues raised.

 

The Committee thereupon:

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A of the Local Government Act 1972.Following the adjournment, the Committee reconvened to advise of its decision.

 

UNANIMOUSLY RESOLVED that Miss Carolyn Anne Evans’ license be suspended for the period between 6:00pm on 25th October 2024 to 6:00am on 28th October 2024

 

REASONS :

 

On the facts presented, the Committee was satisfied that there was reasonable cause to suspend Miss Evans’ licence but that the mitigating factors warranted only a very short period of suspension.

 

12.

MR ABDALLAH MOHAMED AHMED - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee considered an application from Mr Abdallah Mohamed Ahmed of Mountain View, Clos Anthony, Johnstown, Carmarthen for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence. 

 

The Committee interviewed Mr Ahmed with regard to his application and the issues raised by the Senior Licencing Officer.

 

The Police Representative was afforded the opportunity to provide information in relation to the issues raised.

 

The Senior Licensing Officer recommended that Mr Ahmed’s application be refused.

 

UNANIMOUSLY RESOLVED that the application submitted by Abdallah Mohamed Ahmed for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence be granted.

 

REASONS :

 

On the evidence presented the applicant is a fit and proper person to hold a licence.

 

13.

MR MOHAMAD NAYRAB - APPLICATION FOR A HACKNEY CARRIAGE/PRIVATE HIRE DUAL DRIVERS LICENCE

Minutes:

The Committee considered an application from Mr Mohamed Nayrab of 15 Park Hall, Carmarthen for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence. 

 

The Committee interviewed Mr Nayrab with regard to his application and the issues raised by the Senior Licencing Officer.

 

The Police Representative was afforded the opportunity to provide information in relation to the issues raised.

 

The Senior Licensing Officer recommended that Mr Nayrab’s application be refused.

 

UNANIMOUSLY RESOLVED that the application submitted by Mr Mohamad Nayrab for the grant of a Hackney Carriage/Private Hire Dual Driver’s Licence be granted.

 

REASONS :

 

On the evidence presented the applicant is a fit and proper person to hold a licence
