The Solicitor briefed all present on the procedure for the meeting. The Chair outlined that Mr Dafydd Aled Rees Jones of Llwynhenri, Porthyrhyd, Carmarthen SA32 8PP held a Personal Licence with the Authority.

 

The Licensing Lead informed that licensing had become aware via a news report that Mr Jones had been convicted of a relevant offence which required consideration by the Sub-Committee in respect of Mr Jones’ personal licence. A written statement which provided an account of the incident had also been submitted by Mr Jones and was circulated to the Sub-Committee during the meeting.

 

Oral representations were also received from the Dyfed Powys Police representative and Mr Jones. 

 

The Members and all parties present were afforded the opportunity of questioning regarding the representations made.

 

The Licensing Lead recommended that consideration be given to suspend or revoke Mr Jones’ personal licence.

 

The Sub-Committee thereupon

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12 to the Local Government Act.

 

Having regard to the relevant paragraphs of the Licensing Authority’s Statement of Licensing Policy and the guidance issued by the DCMS and the Home Office, it was:

 

FURTHER UNANIMOUSLY RESOLVED, having considered all the evidence before it, that Mr Jones’ personal licence be suspended for a period of 2 weeks.

 

REASONS

 

In coming to its decision, the Sub-Committee made the following findings of fact:

 

  • The licensing authority became aware of the personal licence holder’s conviction for a relevant offence via the press rather than via the personal licence holder.

 

  • The information provided by Dyfed Powys Police as to the personal licence holder’s alcohol consumption at the time of the incident was accepted.

 

Having borne in mind the personal licence holder’s responsibilities as a personal licence holder, the Sub-Committee is satisfied that its decision (outlined above) is appropriate to promote the licensing objectives.

The Licensing Lead advised that following publication of the meeting documentation, a query had arisen in relation to an aspect of the offences being considered.  To enable the Authority to obtain the required clarification from Dyfed Powys Police, it was requested that consideration of the matter be deferred by the Sub-Committee for a period of 1 month.

 

Having considered the oral representations received, it was:

 

UNANIMOUSLY RESOLVED that consideration of Mr Luigi Presutti’s Personal Licence be adjourned for 1 month.

 

REASONS

 

In coming to its decision, the Sub-Committee made the following findings of fact;

 

  • The licensing authority’s indication that further clarification was needed from Dyfed Powys Police as to the offences being considered was accepted.

 

The Sub-Committee was therefore satisfied that its decision (outlined above) was necessary for its consideration of the matter.
