The Chair and Solicitor briefed all present on the procedure for the meeting. The Chair outlined that the Sub-Committee were required to consider an application  from Mr Jonathan James Thomas & Nicola Sian Bowes Thomas, for a premises licence in respect Donuts & Dragons, 7b King Street, Carmarthen.

 

The Sub-Committee noted that the following documentation was attached to the report:

 

·         Appendix A – Copy of the application documents

·         Appendix B – Representations submitted by the Licensing Authority

 

The Sub-Committee received oral representation from the Licensing Authority representative. The Licensing Authority representative clarified that the application was for a premises licence to permit:

-       the supply of alcohol indoors- Monday- Sunday 12.00-22.30 and New Years Eve 12.00-00.30 (not 23.00-00.30 as detailed in the report).

 

It was also noted that the application was for:

-       recorded music indoors- New Years Eve until 01.00

-       opening hours- Monday- Sunday 10.00-23.00, New Years Eve until 01.00

 

The Licensing Authority representative referred to his written representations and confirmed that if the Sub-Committee were to determine that the premises licence be granted, the applicant and the licensing authority had agreed 6 licence conditions which it was suggested be attached to the licence.

 

The Members and the applicant were afforded the opportunity of questioning the Licensing Authority representative on his representations made.

 

Mr Thomas (the Applicant) presented his representations concerning the application and responded to the comments made by the Licensing Authority representative.

 

The Members and the Licensing Authority representative  were afforded the opportunity of questioning the applicant on his submission.

 

The Sub-Committee thereupon

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12 to the Local Government Act.

 

Having had regard to the relevant paragraphs of the Licensing Authority’s Statement of Licensing Policy and the guidance issued by the DCMS and the Home Office, it was:

 

RESOLVED that having considered all the evidence before it, the Sub-Committee finds that the application be granted subject to the licence conditions 1-6 (as agreed by the licensing authority and the applicant set out below).

 

1.

The sale of alcohol shall be made by table service only.  All alcoholic drinks must be ordered, served and consumed at a table.

2.

The consumption of alcohol whilst standing is not permitted in the premises.

3.

Customers are not permitted to sit at the counter or servery where drinks orders are taken, prepared or dispatched.

4.

The sale of alcohol will be incidental to the playing of board games at the premises.

5.

Alcohol sales are for consumption on the premises only. No drinks to be taken out of the premises.

6.

Only low background level recorded music to be played at the premises.

 

REASONS:

 

In coming to its decision, the Sub-Committee has made the following findings of fact;

 

  1. The licensing authority and the applicant agreed the licence conditions 1-6 (as set out above)
  2. The supply of alcohol is not the primary part of the business

The Chair and Solicitor briefed all present on the procedure for the meeting. The Chair outlined that the Sub-Committee were required to consider an application from Mr Edward Hayden Robert Lee, for a premises licence in respect of Anvil Kitchen, 2 Ffordd Y Glowyr, Betws, Ammanford to permit:-

 

  • The Supply of Alcohol - Monday to Sunday 09:00 - 16:00hrs;
  • Opening Hours - Monday to Sunday 09:00 - 16:00hrs;

 

The Sub-Committee noted that the following documentation was attached to the report:

 

·         Appendix A – Copy of the application and supplementary documents

·         Appendix B – Representations submitted by other persons

·         Appendix C – Applicant’s response to representations received and a letter of support from a resident

 

The Sub-Committee received oral representations from the objector re-iterating the information detailed in Appendix B of the report. 

 

The Members and the applicant were afforded the opportunity of questioning the objector regarding the representations made.

 

The applicant was then afforded the opportunity of presenting his representations concerning the application and responding to the comments made by the objector. 

 

The Members and the objector present were afforded the opportunity of questioning the applicant on his submission.

 

The Sub-Committee thereupon

 

UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12 to the Local Government Act.

 

Having had regard to the relevant paragraphs of the Licensing Authority’s Statement of Licensing Policy and the guidance issued by the DCMS and the Home Office, it was:

 

RESOLVED that having considered all the evidence before it, the Sub-Committee finds that the application be granted subject to the following:

- alcohol is to be consumed on the premises.

- alcohol sold for consumption off the premises must be taken out of the premises in a sealed container.

 

REASONS:

 

In coming to its decision, the Sub-Committee had made the following findings of fact;

 

  1. There is a children’s play area in close proximity to the premises
  2. The imposition of the additional conditions are considered appropriate to address concerns in that regard.

 

The Sub-Committee is therefore satisfied that its decision (outlined above) is appropriate to promote the licensing objectives.
