The Executive Board Member considered an application to divert a Byway Open to All Traffic (BOAT) 57/42 at Bryndias Farm, Pinged, made under section 117 of the Highways Act (1980) for reasons of security and for public safety. The application satisfied the test laid out in section 116 of the Highways Act 1980 (under which the Diversion Order would be made), namely that it would be more commodious to the public as it would remove the BOAT from the residential curtilage of Bryndias Farm and reduce the overall number of gates on the route from 5 to 3. Two objections received had later been withdrawn following further explanation and some amendments to the proposed width.

 

RESOLVED that the application be approved and that the necessary Notice of Application be heard at the relevant Magistrates Court.

FOLLOWING CONSIDERATION OF ALL THE CIRCUMSTANCES OF THE CASE AND FOLLOWING THE APPLICATION OF THE PUBLIC INTEREST TEST THE EXECUTIVE BOARD MEMBER MAY CONSIDER THAT THE FOLLOWING ITEM IS NOT FOR PUBLICATION AS IT CONTAINS EXEMPT INFORMATION AS DEFINED IN PARAGRAPH 17 OF PART 4 OF SCHEDULE 12A TO THE LOCAL GOVERNMENT ACT, 1972 AS AMENDED BY THE LOCAL GOVERNMENT (ACCESS TO INFORMATION) (VARIATION) (WALES) ORDER 2007.

 RESOLVED pursuant to The Local Government Act, 1972 as amended by The Local Government (Access to Information) (Variation) (Wales) Order 2007 that the following items were not for publication as the reports contained exempt information as defined in Paragraph 17 of Part 4 of Schedule 12A to the Act.

Following the application of the public interest test it was RESOLVED pursuant to the Act referred to in minute no. 4 above not to publicise the content of the report as it contained exempt information that reveals that the Authority proposes to make an Order or Direction under any Enactment (Paragraph 17 of Part 4 of Schedule 12A to the Act).

The public interest test in this matter related to the fact that the report contained details of proposed Orders to be made by the Mineral Planning Authority to prohibit the resumption of mineral working at particular sites within the County, subject to confirmation by the Welsh Government. Disclosure of the proposed sites at this time is likely to undermine the administration of justice, and therefore on balance the public interest in disclosure is outweighed by the public interest in maintaining confidentiality.

The Executive Board Member considered a report which recommended the serving of Prohibition Orders in relation to a number of long dormant mineral working sites so as not to perpetuate historical and unsustainable patterns of supply and to ensure that supply was managed in a sustainable way and struck a balance between environmental, economic and social considerations.

RESOLVED that Prohibition Orders be served in relation to the sites referred to in the report in order to prevent the resumption of winning and working of minerals thereat.
