FOLLOWING CONSIDERATION OF ALL THE CIRCUMSTANCES OF THE CASE AND FOLLOWING THE APPLICATION OF THE PUBLIC INTEREST TEST THE EXECUTIVE BOARD MEMBER MAY CONSIDER THAT THE FOLLOWING ITEM IS NOT FOR PUBLICATION AS IT CONTAINS EXEMPT INFORMATION AS DEFINED IN PARAGRAPH 14 AND 16 OF PART 4 OF SCHEDULE 12A TO THE LOCAL GOVERNMENT ACT, 1972 AS AMENDED BY THE LOCAL GOVERNMENT (ACCESS TO INFORMATION) (VARIATION) (WALES) ORDER 2007

RESOLVED pursuant to The Local Government Act, 1972 as amended by The Local Government (Access to Information) (Variation) (Wales) Order 2007 that the following items were not for publication as the reports contained exempt information as defined in Paragraph 14 and 16 of Part 4 of Schedule 12A to the Act.

HEOL WALLASEY LEASEHOLD SERVICE CHARGE

Minutes:

Following the application of the public interest test it was RESOLVED pursuant to the Act referred to in minute no. 3 above not to publicise the content of the report as it contained exempt information relating to the financial or business affairs of any particular person (including the Authority holding that information) (Paragraph 14 of Part 4 of Schedule 12A to the Act) and information in respect of which a claim to legal professional privilege could be maintained in legal proceedings (Paragraph 16 of Part 4 of Schedule 12A to the Act).

 

The public interest test in this matter related to the fact that by disclosing the information contained within this report as disclosure would have the potential to have a disproportionate effect upon the individuals concerned and would not be necessary for any of the purposes specified in Schedule 2 of the Data Protection Act 1998. Furthermore, the report contained legally privileged information which, if disclosed would undermine the ability of the Council to take or defend legal action in relation to leasehold service charges, thereby harming the public purse.

 

The Executive Board Members for Resources and Housing considered a report which provided background information on the position regarding building works at Heol Wallasey and recovery of costs from leaseholders.

 

The Executive Board Members noted that the matter of the leasehold charges had not been resolved.

 

The report outlined three options and recommended that the Executive Board Members consider the most appropriate course of action.

 

UNANIMOUSLY RESOLVED that option 2, as set out in the report be agreed and actioned.
