The Cabinet Member considered a report detailing a sundry debt account in relation to lease rental fees owed by Bob Jones, Prytherch & Co Marts Ltd in the sum of £390,773,56 identified as being irrecoverable.  Recovery procedures, where appropriate, had been exhausted and there was no likelihood of payment being secured. It was therefore considered appropriate to write-off the account.

 

The Cabinet Member noted that Counsel’s advice obtained on the matter had focussed on whether there was sufficient evidence of company assets available to meet any judgement that may be obtained by the Council or generally to meet its liabilities to the Council. Furthermore, as the company no longer appeared to be trading, and was intended to be dissolved, there was very little to suggest any enforcement action taken to recover the debt would be proportionate to the expense associated therewith or that the company would be able to meet the consequences of that action. Consequently, having regard to the circumstances of the matter, it was noted there was no likelihood of the debt being recoverable.

 

RESOLVED that the sundry debt account relating to lease rental fee arrears owed by Bob Jones, Prytherch &Co Marts Ltd in the sum of £390,773,36 as detailed within the report be written-off as irrecoverable.

FOLLOWING CONSIDERATION OF ALL THE CIRCUMSTANCES OF THE CASE AND FOLLOWING THE APPLICATION OF THE PUBLIC INTEREST TEST THE CABINET MEMBER MAY CONSIDER THAT THE FOLLOWING ITEMS ARE NOT FOR PUBLICATION AS THEY CONTAIN EXEMPT INFORMATION AS DEFINED IN PARAGRAPH 14 OF PART 4 OF SCHEDULE 12A TO THE LOCAL GOVERNMENT ACT, 1972 AS AMENDED BY THE LOCAL GOVERNMENT (ACCESS TO INFORMATION) (VARIATION) (WALES) ORDER 2007.

RESOLVED pursuant to the Local Government Act 1972, as amended by the Local Government (Access to Information)(Variation)(Wales) Order 2007 that the following items were not for publication as the reports contained exempt information as defined in Paragraph 14 of Part 4 of Schedule 12A to the Act.

Following the application of the public interest test it was RESOLVED pursuant to the Act referred to in minute 4 above not to publicise the content of the report as it contained exempt information relating to the financial or business affairs of any particular person (including the Authority holding that information) (Paragraph 14 of Part 4 of Schedule 12A to the Act).

 

The public interest test in this matter in maintaining the above exemption outweighed the public interest in disclosing the information contained in the report as disclosure would undermine the Council’s negotiating position in similar transactions in the future and risk harming public finances.

 

The Cabinet Member considered a report on proposals for an easement at land to the rear of Llwyn yr Ynys (Sheltered Housing) Llwynhendy, Llanelli.

 

RESOLVED that the proposals for the easement on land to the rear of Llwyn yr Ynys (Sheltered Housing) Llwynhyendy, Llanelli be approved on the terms detailed within the report subject to a rodent survey being undertaken.
